ICC gives green light to investigate US crimes in Afghanistan

Appeals judges at the International Criminal Court (ICC) have given the green light to prosecutors to open an investigation into war crimes and crimes against humanity by the US in Afghanistan.

"The prosecutor is authorized to commence an investigation into alleged crimes committed on the territory of Afghanistan since May 1, 2003," ICC judge Piotr Hofmanski said in a ruling on Thursday.

"It is for the prosecutor to determine whether there is a reasonable basis to initiate an investigation" under the court's statutes, the judge added.

The court upheld an appeal by prosecutors against a pretrial chamber's rejection in April last year of chief prosecutor Fatou Bensouda's request to open a probe in Afghanistan.

In 2006, the ICC's prosecutors opened a preliminary probe into possible war crimes and crimes against humanity committed in the Asian nation since 2003.

In 2017, prosecutor Bensouda asked judges to allow a full-blown probe, not only into Taliban and Afghan government personnel but also international forces, US troops and members of the Central Intelligence Agency (CIA).

Bensouda's move angered Washington, which in April last year revoked the Gambian-born chief prosecutor's visa as part of broader restrictions on ICC staff probing American or allied personnel.

Former national security adviser John Bolton warned in 2018 that the US would arrest ICC judges if the court pursued an Afghan probe.

New York-based Human Rights Watch (HRW) and other international rights bodies on Thursday hailed the decision to uphold the prosecutions' appeal.

"The decision also sends a much-needed signal to current and would-be perpetrators of atrocities that justice may one day catch up to them," HRW's Param-Preet Singh said.

The US invaded Afghanistan to overthrow a ruling Taliban regime in 2001. American forces have since remained bogged down in the country through the presidencies of George W. Bush, Barack Obama, and Donald Trump.

About 2,400 US soldiers have been killed, along with unknown tens of thousands of Afghan troops, Taliban militants and Afghan civilians.

America has spent more than $1 trillion in fighting in Afghanistan.

Fighting has continued ever since -- last year more than 3,400 civilians were killed and almost 7,000 injured, according to data provided by UN agencies.

Over 100,000 Afghans have also been killed or injured since 2009, when the UN Assistance Mission in Afghanistan began documenting casualties.

The direct US-Taliban talks were launched in 2018 as part of a push by US President Trump's administration to strike a deal with the militant group.

Trump has long expressed eagerness to bring US soldiers home and to end the country's longest war as he seeks re-election in 2020.

After nearly two decades of war, the United States and the Taliban last week signed an agreement aimed at paving the way for complete withdrawal of American forces from Afghanistan.

About 14,000 US troops and approximately 17,000 troops from NATO allies and partner countries are stationed in Afghanistan.

The Taliban now control or hold influence over more Afghan territory than at any point since 2001.

Experts say, however, that it is the Afghan government and the Taliban, rather than the US and the militant group, who should address important questions on the future of Afghanistan.

Very Important Information regarding Palestine, The UN, and the future of mankind

September 20th, 2011 can be a step in the right direction and a day for Global Freedom.

September 20th, 2011 marks a day in which history will be written one way or the other. It is my hope that people will rise to this occasion and express their opinions based on moral human rights, respect and empathy for life. I ask you to share this video and stand with me in support of a FREE Palestine, a land that was divided in 2 by the United Nations in 1948.

The UN has broken its charter in many war theaters including the recent war crime in Libya. If the US government is allowed to Veto the motion that grants the recognition of a Palestinian state by the General UN assembly then the truth about democracy will have to be revisited and explained, for who would want to be a part of a World Body that dictates an agenda from special interests. That is NOT democracy.

Should a Veto occur on the Palestinian question of self determination and the right to exist, then the principals of the UN and the Charter will be null and void; in which case I will urge every peace loving nation to walk out and end this institution and rebuild one in its place that allows ALL nations to come to the table as equals. We are at a defining moment in history, where real action MUST be taken for our children’s, children’s future; think wisely because when your grandchildren ask you, “What did YOU do?” will you have an answer in tune with peace, love, and empathy, or one of ignorance?

US double-standard on war crimes

Source: Press TV
http://www.presstv.ir/detail/167513.html

The US has been pushing for a measure that would keep its agents from being prosecuted for war crimes committed during the bloody massacre of pro-democracy protesters in Libya.

The hypocritical move came on Sunday as the US called for the International Criminal Court (ICC) to investigate the killing of Libyan demonstrators, while insisting on excluding a large number of foreign mercenaries.

The US insisted that the Security Council assures all mercenaries -- from countries that are not a member of the ICC -- hired by Gaddafi would not be punished for their actions in Libya.

This means that mercenaries from countries such as Algeria, Ethiopia and Tunisia would escape prosecution even if they are captured, because their nations are not members of the court.

The move was seen as an attempt to prevent the prosecution of US soldiers and officials over war crimes, The Telegraph reported.

In this particular case, however, there has been no indication that any US citizens have been involved in the Libyan massacre.

The US apparently has threatened to kill the entire resolution if the immunity clause is not inserted.

So far around two thousand people have been reportedly killed in Libya due to the Gaddafi regime's excessive use of force.

Declare War Crimes on the Bush Administration

Greetings and felicitations,

My name is Stewart, and I am from Canada. I am pleading with you, my fellow human beings, to please join with me on a quest to end the War and occupation in Iraq. Lets stop the madness in Iraq together by sending a letter to The International Criminal Court of Justice and call for A War Crimes trial against George Bush, Dick Cheney and their corporate thieves.

The aggressive War that the United States launched on Iraq is a War Crime! The fact that the Americans are still in Iraq committing atrocities is grievous and malevolent to the human spirit. The United Nations has failed us because our governments have not stood up against George Bush and taken action. Therefore, it is up to us, the people of the World to do so. The International Criminal Court upholds our rights as human beings and is a World Body at the heart of what has been defined as Human morals and Law. Our letter campaign will focus pressure in that place.

Please write a letter or simply copy the one below and send it to the "The Office of the Prosecutor" at the International Criminal Court of Justice.

Dear Sirs,

I would like some information on how accusations of War Crimes & Crimes Against Humanity might be reported, determined and acknowledged? What is the process of going from accusations to trial?

Is waging aggressive War considered a War Crime or crime against humanity? Chief Justice Jackson, the American prosecutor during the Nuremberg trials, asked for a judgement that stated, “any nation that wages aggressive War would be tried for War Crimes and Crimes against Humanity”? At least, it was his intention and dominant in his day two speech at Nuremberg.

I am trying to understand why the U.S.A. has not been accused of committing War Crimes when it invaded Iraq. Is it up to the international court to make accusations, or does another country have to make the claim? Please write back, I am trying to get answers and also to understand if high moral principals are indeed being followed, or if they are just mere words of an age gone by.

Regards,
Stewart Brennan

I wanted to let you know just one of the things I have done to stop the madness in Iraq. I have asked the International Criminal Court of Justice to press charges against the USA for "War Crimes" & "Crimes Against Humanity". I have provided one letter that I wrote and the response to it by the Court.

Please help me in this matter of extreme importance by informing everyone you know to do the same. Write to the court and ask for justice.
